Terms of service

Darkstar Harness ("Darkstar") is software made by smsterling@protonmail.com ("we", "us"). Using Darkstar is governed by the Darkstar Software License v3.0, which ships with every copy as LICENSE.md. These terms cover buying a Professional or Enterprise license through this website. By buying a license or using this website, you agree to these terms.

Who sells it

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

What you're buying

The Community Trial is the downloadable version of Darkstar. It starts the 31-day trial described in the license. Professional and Enterprise are paid plans, and each is a Commercial License under the Darkstar Software License. A Professional license is a monthly subscription for one person. An Enterprise license is a monthly subscription, priced per team member, for the number of team members you purchase. Each permits use of Darkstar, including Commercial Use, for as long as the subscription is active and within the limits of the license.

Billing and renewal

Subscriptions renew automatically at the end of each monthly period until cancelled. You can cancel at any time using the link in your Paddle receipt email; cancellation takes effect at the end of the current billing period, and the rights of the license end when the paid period ends. A license also ends if a payment fails or is refunded or reversed.

Changes

We may update prices for future billing periods. We'll tell you by email before a price change affects your renewal.

Intellectual property complaints

If you believe Darkstar infringes your intellectual property rights, use the contact form and tell us which work is concerned, where it appears in Darkstar, and how to reach you. We will review it and respond.

This website

This site has no analytics, advertising or tracking cookies. It loads fonts from Google Fonts, which receives your IP address to deliver them. When the plans on the license page come into view, the site loads Paddle.js from Paddle so checkout can work; Paddle's privacy policy applies to that. Our hosting provider may log technical data such as your IP address to deliver and secure the site.

When you contact us

If you use the contact form, we receive the name, email address and message you enter, and we use them to reply to you.

When you buy

Paddle collects your name, email, billing address and payment details to process the order, calculate tax and send receipts. Your card details go to Paddle and never reach us. Paddle shares with us what we need to provide and support your license: your name, email, country, the plan and seats you bought, and your subscription status. You must provide the data Paddle asks for to complete an order. Without it, we can't sell you a license.

Why we use your data

To provide your license and support you, which is necessary to perform our contract with you. To answer your messages and keep this site secure, which is our legitimate interest in running a working and secure service. To meet our legal obligations.

Who receives your data

Paddle, our Merchant of Record; the providers that host this site and run our contact form and email; Google Fonts, when it loads fonts; and public authorities where the law requires it. We do not sell your data. Some of these providers may process data outside the European Economic Area. Where they do, they rely on safeguards such as adequacy decisions or standard contractual clauses.

How long we keep it

We keep your data while your license is active and for as long as we need it to support you and meet our legal obligations. After that we delete it or make it anonymous.

Security and automated decisions

We use reasonable technical and organizational measures to protect your data. We do not make decisions about you by automated means or build profiles of you.

The Darkstar app

We do not collect, receive or access your models, prompts, files or outputs, and Darkstar does not send them to us.

Your rights

You can ask us for access to your personal data, ask us to correct it, ask us to delete it where we're not required to keep it, ask us to restrict how we use it, object to how we use it, and ask for a copy in a portable format. Use the contact form. We will respond within one month. You also have the right to complain to your local data protection authority. For data held by Paddle, see Paddle's privacy policy.

Refund policy

You can request a refund within 14 days of your first payment or any renewal.

To request a refund, reply to your Paddle receipt email or contact Paddle at paddle.net. Refunds are processed by Paddle to your original payment method.
